The following conditions establish the general conditions of sale of the products offered by ALL HUMAN on its e-commerce website www.allhuman.fr.

Any order placed on the site www.allhuman.fr supposes the acceptance of the present General Conditions, of which the customer recognizes to have acquainted, to have understood and accepted them with full knowledge of the facts. The present General Conditions are subject to French law and to the French standards in force.

The company ALL HUMAN has for unique activity the sale of ready-to-wear clothing.

ALL HUMAN reserves the right to adapt or modify the present GCS at any time. It is agreed that in case of modification, the version of the GCS applicable to any order is the one appearing online on the site on the day the order is placed.

1 Purpose of the general conditions of sale

The present general terms and conditions of sale aim to define, exclusively because of the relations they establish on the Internet, the reciprocal rights and obligations of the parties as well as the different stages of the order process.

The general conditions of sale apply without restriction or reserve to all sales concluded by ALL HUMAN with non-professional buyers wishing to acquire the articles offered for sale on our website www.allhuman.fr.

The Customer who would like to buy on the site declares to be more than 18 years old and to have full legal capacity or to benefit from the authorization of a person holding parental authority, a tutor or a curator.

Clicking on the icon “I have read and accept the general terms and conditions” means that you accept these general terms and conditions.

The customer declares to have read these General Terms and Conditions of Sale before placing his order. The validation of your order is tantamount to acceptance without reservation of our General Terms and Conditions of Sale, the Legal Notice and the Terms of Use of the site.

The General Terms and Conditions of Sale do not apply to the services or sale of products offered by an entity other than ALL HUMAN.

ALL HUMAN will not be responsible for services or products offered by third parties.

With regard to the protection of your personal data collected on the E-shop, we invite you to consult our Personal Data Protection Policy.

The use of the online sales process described in these general terms and conditions of sale is reserved for consumers acting exclusively on their own behalf. The Products are therefore not intended to be resold.

The present general terms and conditions of sale and the order summary transmitted to the customer form a contractual whole and constitute the entirety of the contractual relations between the parties.

2 Identification of the offeror

ALL HUMAN EURL with a capital of 5000 €, registered in the Trade and Companies Register of Strasbourg under the SIREN number 852584713, whose registered office is located 52 Rue de la Bruyère – 67400 Illkirch and whose intra-community VAT number is FR48852584713.

3 Product

A detailed description of ALL HUMAN products is available when viewing each of them individually on the E-shop.

The system thus set up supposes an active approach on your part. It complies with the legal requirements for online sales and consumer protection.

The products offered for sale by ALL HUMAN are those which appear on the site and only on the site on the day of consultation by the user and within the limit of available stocks.

In the event of unavailability of an article after placing the order, due to a problem of delivery from our suppliers or a difference in stock, the buyer will be informed as soon as possible by e-mail. The cancellation of the unavailable item and its refund will then be made, the rest of the order remaining firm and final.

The products offered for sale are described and presented as accurately as possible. However, if errors or omissions may have occurred with regard to this presentation, ALL HUMAN cannot be held responsible. The photographs and texts illustrating the products are not contractual.

4 Orders

When you place your first order, we will ask you to fill out an order form specifying certain mandatory fields so that we can process your order.

In the event of prolonged inactivity during connection it is possible that your selection of ALL HUMAN products chosen before this inactivity is no longer available. You will then be invited to resume your selection of ALL HUMAN products from the beginning.

Before any final order, you will have the possibility to check the details of your order and its total price, and to correct possible errors, before confirming it to express your acceptance. Any order placed implies, on your part, an obligation of payment.

For any order that you will carry out on our E-shop, an email of confirmation will be sent to you mentioning in particular the number of your order and the detail of the ordered ALL HUMAN products.

All the steps necessary for the order are specified on our site.

Despite all the care we take in presenting ALL HUMAN products on our E-shop, we cannot guarantee that their real appearance corresponds exactly to their appearance on the screen.

We reserve the right to limit the quantities of ALL HUMAN products that we supply, and/or to refuse any abnormal order or order placed in bad faith. In addition, we reserve the right to refuse any order from a customer with whom there is a dispute over payment of a previous order.

Certain products may be subject to import restrictions specific to certain countries.

5 Prices

The price of ALL HUMAN Products is indicated in Euros (€), all taxes included.

You will not benefit from a refund of VAT for your purchases on our site.

The indicated prices are guaranteed within the limit of available stocks, except important modifications of the charges and in particular of the VAT, and except typographical error or omission.

The prices indicated do not take into account delivery charges outside of Metropolitan France, which will be invoiced in addition and will be specified to the user during the final validation of his order.

You pay the total cost of the order in a single payment.

An invoice will be sent to you by e-mail, detailing your ALL HUMAN Products as well as their price and the total amount of the payment.

We pay the greatest attention to the accuracy of the prices in our E-shop. However, in the event of error on our part, we reserve the right not to supply ALL HUMAN Products whose price would be obviously erroneous.

We can modify the prices indicated in our E-shop, at any time and without notice. However, the modified prices will only be applied to new orders, with the exception of orders already placed.

There are no customs duties when ALL HUMAN Products are delivered within the European Union.

Outside of the European Union, charges and customs duties depend on the country to which the ALL HUMAN Products are delivered.

6 Ordering

The Customer who wishes to place an order chooses the different Product(s) of his choice by clicking on “Add to cart”.

At any time the Customer has the possibility to :

  • Check the number of Products contained in his basket and obtain detailed information on each of them,
  • Continue its selection of Products,
  • Finish the order by clicking on the “Order” button.

The validation of the cart confirmation constitutes an electronic signature. This signature between the parties has the same value as a handwritten signature and is proof of the completeness of the order and the payment of the sums due in execution of the said order. As soon as he has validated his order, the Customer becomes a Buyer. Notwithstanding the application of Article R624-3 of the French Penal Code, the Customer shall pay for his order by credit card (Carte Bleue, Visa, Visa Electron, e-carte Bleue, CB Pure, Mastercard, Maestro, Amex, Cetelem Aurore) by filling in the information required by the secure payment platform.

After validating his or her payment method, the customer definitively and irrevocably validates his or her order.

The customer will indicate that he or she accepts the general terms and conditions of sale by ticking the box “I have read and accept the general terms and conditions”.

ALL HUMAN will acknowledge receipt of the order as soon as it has been validated by e-mail or by any other means at its convenience. By the validation of the order, the customer certifies that he/she either is 18 years old or has parental authorization to proceed with the order. The authorized minor undertakes to inform the parental authority of the collection of his personal data, which may oppose their conservation.

In any case, ALL HUMAN reserves the right to refuse any order or delivery in the event of a dispute with the customer, total or partial non-payment of a previous order by the customer, refusal to authorise payment by bank card from banking organisations, non-payment or partial payment, use of a bank card or other means of payment not issued by a financial institution. The responsibility of ALL HUMAN can then in no case be engaged in this respect.

ALL HUMAN also reserves the right to cancel any order without any reason mentioned above in return for a refund of the amount paid by the customer at the time of the last order.

7 Availability

In the event of unavailability of the article after placing the order, ALL HUMAN undertakes to inform the customer by e-mail as soon as possible upon receipt of the information. The order will be automatically cancelled and the customer immediately refunded if his account has been debited. The refund will be made directly to the customer’s bank account within thirty days at the latest from the payment of the sums paid by the customer.

8 Terms of payment

The following payment methods are accepted: credit cards (Carte Bleue, Visa, Visa Electron, e-carte Bleue, CB Pure, MasterCard, Maestro, Amex, and Cetelem Aurore)

You guarantee that you are the holder of the bank card to be debited and that the name on the card is yours.

You then provide the sixteen-digit number and expiry date on the front of your bank card, as well as the numbers of the visual cryptogram on the back. These data are encrypted during their entry and transmission according to the SSL protocol (confirmed by the appearance of “https” in the URL displayed on the screen).

If the amount due cannot be debited for any reason whatsoever (stop payment on the card, refusal by the issuing bank, etc.), the order and the online purchase process will be immediately cancelled.

The non-transmission of data related to an order prevents the completion and analysis of the corresponding transaction.

The occurrence of an outstanding payment due to fraudulent use of a bank card will result in the registration of the details relating to the order associated with this outstanding payment within a payment incident file. An irregular declaration or an anomaly may also be subject to specific processing.

Some banks charge additional fees for money transfers abroad and/or credit card transactions. It is your responsibility to check this before placing an order with your bank. ALL HUMAN will not bear any of these charges.

9 Personal Data

Any customer who has placed at least one order is automatically registered free of charge in the customer file of the company ALL HUMAN.

ALL HUMAN assures that the data will remain confidential and will never be transmitted unless agreed with the customer.

In accordance with the Data-processing law and Freedoms of January 6, 1978, updated by the law of August 6, 2004, the Customer has a right of access, correction and opposition to the data concerning him.

10 Delivery

Your ALL HUMAN products will be delivered to the shipping address that you indicated when you placed your order, after the payment of the amount of the order has been validated.

Except in special cases or unavailability of one or more ALL HUMAN products, ALL HUMAN products of the same order will be delivered at once.

Your order will be dispatched within an indicative period of 2 to 3 working days (weekends and public holidays are excluded). These deadlines are communicated as an indication. In accordance with the provisions of the Consumer Code, the delivery of the ordered items will take place in any event no later than 30 days from the order, subject to full payment of the price.

Although ALL HUMAN tries to ensure the delivery as soon as possible, ALL HUMAN cannot be held responsible in case of late delivery.

It is specified that orders registered on the website www.allhuman.fr on Saturday or Sunday are processed on the following Monday, the same applies to a public holiday during the week.

If, at the time of delivery, the external aspect of the parcel is not perfect, we invite you to proceed to its opening in order to check the state of the ALL HUMAN products delivered. In the event of damage to the products, please detail them precisely by contacting our customer service.

Delivery charges are displayed on the website and are subject to revision or modification. Delivery charges may be free of charge for orders above a certain amount.

In the case of international delivery, you may be subject to payment of import taxes and additional charges. You must comply with the applicable laws and rules of the country of destination. ALL HUMAN will not be held responsible if the customer violates these laws.

Delivery will not be guaranteed in case of force majeure, transport strike and/or postal services.

11 Customs duties

Any order placed on the site and delivered outside of France may be subject to possible taxes and customs duties that are imposed when the package reaches its destination. These customs duties and possible taxes related to the delivery of an item are the responsibility of the customer. ALL HUMAN is not obliged to check and inform its customers of the applicable customs duties and taxes. To know them, it is up to the customer to inquire with the competent authorities of his country

12 Right of retraction – Return

We strongly recommend that the customer carefully check the garments at the time of delivery before removing any labels or discarding the original packaging. Products must be returned unworn, unwashed, undamaged, unused and with original labels. Failure to comply with these instructions will result in the returned product being considered non-compliant by our return policy and the item will not be refunded. Items benefiting from promotions on our site cannot be returned. Items will be returned at the customer’s expense by a secure delivery method.

You must return the products to us in their original packaging and accompanied by a copy of your invoice.

The buyer has a period of fourteen (14) working days from the date of receipt to return, at his expense, the Product(s) he ordered. Upon receipt of the order, the buyer must check the conformity of the Products with the order.

It will be the responsibility of the customer to keep any proof of return, which implies that the items are returned by registered mail or by any other means giving a certain date to the shipment.

The time limit runs from the reception of the ALL HUMAN products.

When the 14-day period expires on a Saturday, Sunday or public holiday or day off, it is extended to the next working day.

We will refund the returned ALL HUMAN products at the invoiced price (including delivery costs unless the return is only partial), according to the method of payment, within a maximum period of 14 days following the date on which we acknowledge receipt of the returned product and if it is declared compliant after our quality control.

A confirmation email will be sent to you once the returned product has been received and your refund has been made. You will be the only one to be able to exercise this right of retraction. This right cannot be exercised by the recipient of your order.

ALL HUMAN products returned incomplete, damaged, deteriorated, soiled or having been used will not be refunded, nor exchanged and will be returned to the customer.

In the event of an error in the communication of the delivery data, ALL HUMAN will not be held responsible. In case of refusal by the customer of the package, the return postage costs will be applicable.

13 Exchange

If at the time of the exchange request the Product(s) is (are) no longer available, ALL HUMAN undertakes to refund the purchase price within 14 days from the receipt of the Product(s) by ALL HUMAN.

14 Liability – Warranty

You must ensure that the ALL HUMAN products delivered to you correspond to your order. In the event that the ALL HUMAN products delivered are not in conformity with your order, you will have to inform the Customer Service (whose coordinates are indicated in the article “Contact”) and to turn over the Product(s) in question under the conditions stated in the article “Right of retractation”.

In case of lack of conformity we will replace the good, and if this is impossible, we will reimburse you.

15 Force majeure

The notion of force majeure implies circumstances, unforeseeable, irresistible events, independent of the will of the parties and making the performance of the obligation impossible.

Events such as strikes, fire, epidemics, danger of war, civil war, floods, lack of energy resources, bankruptcy of suppliers and others are to be considered as force majeure when they have the effect of delaying deliveries.

The seller shall not have to establish the unpredictability or irresistibility of these circumstances or the impossibility of performance of the contract. The Parties agree to consult each other as soon as possible in order to determine how the order will be processed during the period of the force majeure. Beyond a period of (one) 1 month of interruption for force majeure, the Parties shall be released from their obligations towards each other.

The Seller reserves the right to extend the delivery period possibly agreed with the Customer for a period equal to that during which the case of force majeure has lasted. Likewise, if these facts may compromise the execution of the order in the manner provided for, the seller reserves the right to terminate the contract without commitment or liability on its part.

16 Complaints – Information

17 Intellectual property

The rights to the Site and the Content are protected by international copyright law and any other national laws relating to copyright and databases.

The ALL HUMAN trademark, as well as all photos, illustrations, images and logos appearing on the ALL HUMAN products and on the Site, their accessories or packaging, whether registered or not, are and will remain the exclusive property of the ALL HUMAN company.

Any total or partial reproduction, modification or use of these photos, illustrations, images and logos, for any reason and on any medium whatsoever is strictly prohibited.

The use of all or part of our E-shop, in particular by downloading, reproduction, transmission or representation for purposes other than personal and private use for non-commercial purposes is prohibited.

18 Behaviour

The customer may not use the www.allhuman.fr Site in such a way as to cause, or attempt to cause, interruption of the Site or attempt to force access, or cause damage to the Site. The client understands that he is responsible for all communications and content that he sends from his computer and that the client must use this Site in a lawful manner. Any violation of this clause constitutes a criminal offense that we will refer to the appropriate laws.

19 Site

The customer has the right to speak and share the links of www.allhuman.fr as long as this is done in a legal and fair way, without damaging the reputation of ALL HUMAN and without misusing it. ALL HUMAN reserves the right to remove these links at any time. If ALL HUMAN requests the customer to remove a link to our Site, the customer must do so without delay.

ALL HUMAN may update and change the Site and its contents at any time. This means that at any time the content of the Site may be deemed to be out of date.

Please note that ALL HUMAN provides the Site for domestic and private use only.

ALL HUMAN will not be liable for any loss of business, business interruption or loss of business opportunity.

20 Partial Disability

In the event that one of the clauses of this contract is rendered null and void by a change in legislation, regulations or by a court decision, this shall in no way affect the validity and compliance with these general conditions of sale.

21 Applicable law – Language – Disputes

21.1 Our General Terms and Conditions of Sale are governed by and subject to French law. They are written in French. In the event that they are translated into one or more other languages, only the French text shall be deemed authentic in the event of a dispute.

21.2 In the event of a dispute, you will have the possibility, before any legal action, to seek an amicable solution, and in particular to resort to conventional mediation or any other alternative means of dispute resolution.

21.3 All disputes to which our General Terms and Conditions of Sale may give rise, concerning their validity, interpretation, execution, termination, consequences and consequences will be submitted to the French courts.
